Abused and Refused: Zakhqurey Price denied rights under IDEA
UPDATE Jan 11: Please jump straight to the comments and read the entry by Wampus, my lovely and never-sucessfully-sued-for-cause retired Special Ed Teacher and wife, in regard to standards of confidentiality, labeling and provision of services.
Bump and Update: January 10: Compiled from comments and any other sources I can find.
One of the most interesting developments is that the story on local news channel 5 has been deleted, along with all discussion; I assume that to be in part due to this information being leaked/circulated by the reporter.
This was posted all over the place by Zakh's grandma.
Zakh's grandma here
Hello everyone,Then the story vanished from Channel 5 (no results for any query related to Zach from internal search at all) and the associated discussion was deleted. Mind you, it's rather clear which way it was headed, according to the truncated image Google has of it. It started hateful and went downhill from there.
There is a VICIOUS email be sent to thousands by a prominent LOCAL TV REPORTER that is full of lies. He posted it before talking with me....and when he DID talk to me tonight he didn't mention his bulk email blitz against me!
Here it is:
VICIOUS EMAIL A PROMINENT LOCAL TV REPORTER IS SPREADING TO THOUSANDS OF PEOPLE!
Good ol boy is alive and well!
Please pass along to everyone!
Subject: Email from Darren Bob
Greetings.. I'm wondering how much you have looked into this. I have very
reliable sources that tell me this child has never been diagnosed with Autism.
The Grandmother who is taking care of the child wants a diagnosis, but can find
noone who will do that. In fact, the child HAS BEEN diagnosed as oppositional
defiant .. and that he has been in the juvenile court system for the past three
years because of his behavior. He's only been at this particular school for
three months. I understand there is going to be a court hearing on this
situation next week sometime ( still trying to track that down ) in which I'm
sure more > details will come out.>> That's it .. that's all I know .. hope you
can help me with more info..!!>>>> Daren Bobb> KFSM TV-5> Fort Smith, Ark.>
479-783-1191>
The deletion didn't go over well with one user, who protested. That TOO was deleted - but after Google had indexed it. Here's the Google Cache link.
My Google-Fu is failing me at the moment; I can't seem to find a cache of the original story. Please drop a comment if you have a link.
At any rate, the email seems to raise some important questions for me. Darren Bob's "Very Reliable Sources." You see, the "source" would have to have access to Zachs Special Ed folder, unless, of course Darren Bobb was just making stuff up, or accepting the word of someone who was making stuff up.
Disclosing information from that folder to anyone who does not have direct involvement - parents and persons directly providing services to the child - is very freaking illegal.
So Darren Bob is doing something that is apparently illegal, unethical or incompetent. This is aside from the journalistic ethics issues centering around the idea of taking part in such a dispute.
Any single one of those issues is a "please clear out your desk, security will see you to the door" issue at a reputable media outlet. Of course, Darrin Bobb was formerly a host on a Clear-Channel radio station; it's quite possible he's unfamiliar with the standards of journalistic objectivity I was taught in college. (Or I could just be exhibiting my own bias - but the sin ain't having one, it's pretending you don't have one.)
Fort Smith Radio Host Headed to KFSM
This from an e-mailer: "KWHN-AM morning host Darren Bobb is headed to KFSM-TV. The following job posting came from KWHN Program Director Gary Elmore (his partner on "Arklahoma AM")
We have a rare opening at KWHN as our current co-host has gone on to become anchor and managing editor for the CBS TV affiliate in town.
Therefore, Clear Channel Fort Smith, Arkansas is looking for a Morning co-host for our top rated news talk station, KWHN. Duties also include Assistant PD, remote broadcasts, and commercial production, plus. If you are a team player, please send demo, references and resume to garyelmore@clearchannel.com
Clear Channel Radio is an equal opportunity employer. Women and minorities are strongly encouraged to apply.
Looks like he'll slide alongside Bridget at 5, 6, and 10."
Still, one would expect some modification or restatement of the story. Instead, we see a rather inept cover-up, from which observers can and will no doubt derive their own conclusions regarding media and morality in Arkansas.

Updated Ends;
This is sort of an urgent situation - more urgent than I'd realized - so I'm cobbling it together from other sources.
A Sad Story, and a Call to Action
If you listen to anything autism- or disability- related today, listen to this interview with Carole Reynolds, whose 11-year old autistic grandson Zakhquerey Price is facing felony charges for allegedly injuring two staff members at Beard Elementary (Fort Smith, AK) while said staff members were trying to restrain him.
Zakh's story is really heartbreaking, and demonstrates so many problems with public education, the system of mental institutionalization, and criminal justice system.
Zakh has already faced years of forced institutionalization, including during a period in which he and his family mourn the loss of his sister. Now, he faces criminal charges without adequate legal representation. His family cannot afford a private lawyer, and the public defender assigned to his case does not know much about autism. With the current situation, there is a strong chance that Zakh will be institutionalized against the will of his familyagain. Zakh has already faced years of institutionalization due to a school system which wants to not educate him. He has also been institutionalized during a period in which he and his family are mourning for his younger sister, who died during his period of incarceration in mental institutions.
What can we do to help?
You can donate to Zakh's family so that they might obtain adequate legal representation.
You can contact media outlets about this situation.
You can join the Facebook group to follow the situation and see what else we can do to help Zakh and his family.
This is urgent. Zakh's case is on January 12.
Comments threads over at Autism Women's Network indicate that the Fort Smith Community Of People Who Are In Charge And Who Know Better Than You Do are discomfited by the sudden attention.
More on this over here.
From what I can see so far, it appears that a small town school does not know how to comply with the laws requiring them to provide a "Free And Appropriate Education." And rather than find out, they have apparently done things that at the very least raise the issue that they may have been abusing the Medicaid system. I'd want to know if shuffling kids off the Special Ed budget and onto the Medicaid budget was a common practice. I mean, aside from the involuntary detainment aspects. Those are merely questions of civil, human and family rights, and there is that well-known "autism" exception to the Constitution.
Oh, wait.
(Note: corrected a misunderstanding on my part that Zakh had been incarcerated on the Medicare dime when it was apparently Medicaid-funded. I can never keep those two straight in my head...)

Evangalists of Moloch
It's not mentioned at all in the big ten - but the bearing of false witness, that's right up there. So, if you must throw stones, you might consider starting there. And I assure you, all the things stated about gay people by those responsible for agitating you all to commit what is a legal and moral abomination are liars and are bearing false witness in the precise biblical sense.
Because a "priest" tells you that is a good idea - claiming to speak for God.
Any child may be born gay, and we don't really understand how that happens. But the direct advice to you by these people as to what to do with such children is directly equivalent to sacrifice of children to satisfy an angry pagan god.
The Bible is very direct about what should happen to people who sacrifice children to their god.
A government, encouraged by supposedly religious people people are saying God is in favor of murder. You should probably have a pretty damn good idea as to where this leads, given Africa's history over the last hundred-odd years. I'm not even going to bother making a religious argument against this idea. If your religion says it's good - than your religion is evil. Walk away.

Who shall guard the Guardians
Note that both Stalinist and Fascist states have one thing in common - a certain disdain for human rights and dignity when any particular person or idea is thought to be a threat to the state, for whatever reason, by whatever pinhead happens to be wearing the jackboots.
It was no real surprise to me that the response of Homeland Security was lackadaisical in response to Hurricane Katrina, or that in absorbing FEMA (which was arguably one of the two most competent agencies involved), they had effectively short-circuited it, in favor of not helping non-white and therefore non-deserving people.
But if you want, there are more recent examples of what the real meaning of "homeland security" is, in the words and deeds of those on the ground, wearing the jackboots. I've never been much of a believer in fine words when there are actual deeds to be seen and performance metrics to be evaluated.
It's even more telling that this story comes to us via the New York Times.
Of course, the thugs that landowners employ to keep the workforces in line and content with whatever pittance they are given have, historically never been quite so tolerant of nuance as their employers. They aren't breaking heads in order to secure labor at an acceptable price, they are doing so because they hate Mexicans. They took the job because it would permit them to abuse "Illegals" with impunity - and as the article goes on to observe, they have a tendency to presume that even documented Mexicans are presumed illegal until long after they are abused, detained and no doubt subjected to whatever amuses such racist fuckheads. After federal border agents detained several Mexican immigrants in western New York in June, an article about the incident in a local newspaper drew an onslaught of vitriolic postings on its Web site. Some were racist. Others attacked farmers in the region, an apple-growing area east of Rochester, accusing them of harboring illegal workers. Still others made personal attacks about the reporter who wrote the article.
Most of the posts were made anonymously. But in reviewing the logs of its Internet server, the paper, The Wayne County Star in Wolcott, traced three of them to Internet protocol addresses at the Department of Homeland Security, which oversees border protection.
Homeland Security started an investigation into the posts this month, according to the reporter, Louise Hoffman-Broach, and Richard M. Healy, the Wayne County district attorney. A spokeswoman for the federal agency’s inspector general said she could neither confirm nor deny an investigation; department rules prohibit the use of office equipment for the personal transmission of material that could offend fellow employees or the public.
Coming on the eve of the apple harvest season, the Web posts and the investigation — first reported this week on The Star’s Web site — have ratcheted up longstanding tensions in Wayne County, where farmers and laborers have accused immigration officials of using heavy-handed tactics like racial profiling and arbitrary or unjustified detentions.
Such tactics, the farmers say, have scared Hispanic farm workers from the region just as growers are preparing for the harvest.
Representative Dan Maffei, who represents the area in Congress, said the allegations of overaggressive immigration enforcement, coming from a wide range of constituents, were “of extreme concern.”
But here's the bottom line, America. You have the cheapest food supply in the world PRECISELY because so much of the labor involved is performed by "illegals." So, put up or shut up. Pay producers enough so that they can afford LEGAL wages - and yeah, it's a fact of life that a farm that employs legals and pays union wages CANNOT compete with a farm that does not. That, or accept that you are willing and indeed cheerful eating burgers produced by slave labor kept docile by the friendly folks at ICE. Because, that's exactly what it is, why it's their and the end to which Bush and agrabiz agreed it to be.
All the talk about curbing "illegal" immigration was ginned up to gain support for the existence of said jackbooted thugs stomping around and "defending the nation." Selectively. When the occasion warrants. Say, when a farmer or a rancher says something deemed "inappropriate" by the local Rotary Club leadership.
You see, ICE only has about a thousand field agents. That's a ridiculously low number to deal with the actual problem that we are told exists. But it's just the right size for a flying goon squad. More than enough to turn a town or small city upside down. It's just the right size to punish the fuck out of people. Of course, to confirm your suspicion, you would also look to the institutional culture. What does the group itself think it's actual mandate is, whatever it's fine-sounding mission statement might be?
And for that - well, we have the words of the jackbooted thugs themselves.
The article about the arrests, posted on June 16, led to a torrent of angry Web postings. One, sent from a fake e-mail address, said, “watcha doing to mi wifey, no checky her papeles. she no legal, but she havey benifit card.”
A response, which carried a Homeland Security Internet protocol address, read: “That sounds like my boyfriend. Leave him alones and get your own. My boyfriend works sometimes but he is really good at getting FREE benefits from the Federal and State government.”
Another post, apparently sent from a separate computer linked to Homeland Security, read in part: “These farmers have a problem because the gravy train that they were riding for soooooo long is being brought to light.”
The newspaper removed the posts. It also reported that it had discovered others, dating to last year, that appeared to have come from computers affiliated with Homeland Security.

'Hannity: My Money Where Your Mouth Is' by Keith Olbermann: Update 3
Ironically enough, I had just finished creating this particular design and still had the quote on my clipboard, when I saw a link from Josh to this story in my digg shouts.
'Hannity: My Money Where Your Mouth Is' by Keith Olbermann
And then Keith raises the ante. There are several conditions, to keep Hannity honest - but here's the nub of it.
[Sean Hannity's] offer the other night to Chuck Grodin to 'prove' that waterboarding isn't torture by allowing it to be done to him, is too important to pass up, because of the image it will certainly produce. No matter what he says afterwards or how he tries to laugh it off, Hannity's certitude will be smashed by Hannity's natural, human panic.
I will donate $1,000 (one thousand dollars) for every second of water-boarding Hannity endures. We will start the clock the moment the first water is poured on him. The clock will stop when Hannity confesses or begins to shout or scream on a prolonged basis, or the medical supervisor determines he is danger of organ failure.
If Hannity admits afterwards he was afraid for his life and that waterboarding is indeed torture, I will double my total contribution.
And I will repeat this offer each night on Countdown until he agrees or declines.
Waterboarding; one of the favorites of interrogators, since it leaves no evidence. Keith, allow me to offer several refinements.
First, he must be restrained; otherwise the experience is not authentic. Pallet wrap is a superior choice, because it's simple to use and leaves no ligature marks that might indicate abuse to Red Cross inspectors. If the subject is largely encased, it adds thermal stress, as well as creating an intense sensation of helplessness.
Further - as any interrogator trained at the School of the Americas could tell you - water is one of a variety of choices. One can intensify the experience simply by using your choice of fresh or stale urine, for example. But one of the true classics is, oddly enough, Coke. (Preferred over Pepsi due to it's higher concentration of phosphoric acid.)
Laugh heartily at their distress, repeat ad libidum. Feel free to try it for yourself. Properly done, it's no more dangerous than ordinary nasal irrigation. (Of course, you should irrigate with clean water afterward, there is a risk of yeast infection.)
European officials and lawyers seek to criminalize former US officials over torture charges amid the reluctance of President Barack Obama.
A number of European authorities and human rights groups have expressed dissatisfaction with Obama's failure to press charges against ex-CIA authorities who sanctioned or administered the so-called 'enhanced interrogation methods' to terror suspects, saying that they will make an effort to delve into the torture case under a "universal jurisdiction" code.
Civil rights campaigners say the legal code adopted by some EU countries, authorizes lawyers across the globe to file lawsuits against war criminals, perpetrators of genocides and other human rights offenses, regardless of their country of residence.
In Spain and Germany, lawyers and social liberties activists have brought charges in domestic courts against former US authorities including the ex-defense secretary, Donald Rumsfeld.
UPDATE: The Dark Wraith has a few ideas to add to the authenticity of the experience:
To Sean Hannity: Contact me, son. I know a waterboarding method that will rock your world. Let me do that one to you.UPDATE: for those interested in learning about the International Criminal Court and the possibility of prosecutions under international law, After Downing Street has a suggestion, and some observations you should read for yourself.
Yes, you're going to be stripped naked, and then mocked and otherwise humiliated; but that's not the worst of it, junior: you don't get a blindfold. That's what makes this waterboarding technique so cool. You, yourself, get to watch the action. Some people have said they actually see themselves while it's happening.
Ten seconds in; then I pull you, ask you a question you will most definitely not want to answer on national TV, and if you don't tell me what I want to hear, you get 10 more seconds.
I promise, that first 10 seconds will be the longest of your miserable life. The second 10 seconds will make the first 10 seem like a walk in the park. We'll let the viewing audience do a call-in vote on when we stop if you haven't already cracked on one of the first two pulls. Most definitely, you're not the one who decides the parameters of this game. You have to be powerless, just like the detainees to whom we do these things. Maybe even if you tell me what I want, I'll tell you you're a liar and keep at it. That's how it works with state-sponsored violence.
When we're done, I'll share with you something really important. Even though you might be shaking, even though you might be blubbering like a baby, even though you might be soiling yourself, I'll tell you the big news, and I'll say it like this, right in your ear, just the way the drill sergeants used to tell it to all the boot camp trainees to tear them down so they'd die on command like so many pack animals:
"You, Sean Hannity, ain't nuthin' but a pussy."
UPDATE: Over at dKos, there's a fundraiser and some thoughtful insights to be found amid the sound and fury. I don't usually go there - their infrastructure and my computer do not get along at all well - but for some reason, this has become a partisan issue. I find that truly amazing - to the extent that I may actually dust off my diary account there and post to that effect.
One of the best books published in Canada last year is one of the best books published in the United States thus far this year: "The Sun Climbs Slow: The International Criminal Court and the Struggle for Justice," by Erna Paris.
Some helpful soul regisered a domain - waterboardinghannity.com - for the information and enlightenment of Sean Hannity, featuring several informational videos.
Meanwhile, it occurred to me that if one looks to television to excuse and justify torture (Jack Baur, 24), one can easily find television that makes the opposite case with equal or greater power.
I give you a scene from "La Femme Nikita."
The use of rats is a classic, based on the same principles as the actually authorized technique of placing "stinging insects" into contact with the "subject." I assure you, the only fiction herein are the charactors and dialogue - and perhaps the use of an EEG.
Most professionals find that involuntary cues - struggling, screaming and voiding - more than sufficient to their needs.
There is - or should have been - a solid, ethical, moral foundation for saying something like this to the American people:
"War crimes will be prosecuted, war criminals will be punished and it will be no defense to say, 'I was just following orders'." --GW Bush
But, as he said it in 2003, we may be a tad skeptical. The timeline argues that it's only a "war crime" if the prosecution for "war crimes" is simply another way of separating the "winners" from the "lusers." In other words, just like waterboarding and the whole "Gitmo" experience.
Update - Still nothing from Hannity - the amusement continues here..

The Abuse Excuse
A Disgruntled Republican: Regarding Torture: "It is worth keeping in mind, that the CIA was not operating in a vacuum. This was not just George W. Bush and Dick Cheney acting independently or the CIA going it alone. There was Congressional oversight. Top legislators knew of interrogations. The CIA briefed Democrats and Republicans on the congressional intelligence committees more than 30 times about the use of enhanced interrogation techniques. Congress could have stopped it. Congress did not object or withhold funding.I've written and blogged a fair bit about torture and abuse over the years, and have a rather personal perspective on the effects and causes of it, having suffered more than my share.
Among those who were briefed and tacitly approved the techniques were many of the same Democrats, including Nancy Pelosi, who now want to prosecute George W. Bush. We should keep in mind, that these techniques occurred in the aftermath of 9/11 when everyone thought that another attack was eminent. If I would I have been one of the congressmen who sat in on the CIA briefing, would I have objected and publicly condemned it? I don’t think I would have. Maybe later I would regretted that I did not, but at the time, I would have probably acted no differently than the congressmen who sat in on those briefings. If Bush is prosecuted for approving the use of torture, so should Nancy Pelosi and every congressman who acquiesced and did not publicly object and try to stop it at the time. That is all of them."
"Quantity has a quality of it's own," as the old Soviets used to say. I shall spare you and your readers the details; simply put, though, a child who is abused both in school and at home has no safe place or people to trust.
I have galloping PTSD and have suffered from chronic depression since grade school. Aside from being on the Autistic Spectrum - something I was born with - I became as a consequence a polyfragmented multiple personality as a means of survival. I've been involved in various awareness campaigns over the years, and in each and every attempt to bring attention to the consequences of abuse by the "pillars of the community" against those weaker and less well connected, one feature is always some socially-justified apologea such as this.
Perhaps the argument is novel to the writer, it is not to me. It's a transparent attempt to evade personal and collective guilt by making responsibility for the evils committed so universal as to be meaningless. And that, frankly, is bullshit.
"If I would I have been one of the congressmen who sat in on the CIA briefing, would I have objected and publicly condemned it?"Yes. I would have. No doubt this would have precluded my being briefed in the first place. Or are you so naive as to think that anyone on those "oversight committees" is one likely to operate from any genuine ethical or moral perspective? Those unwilling to "go along to get along" are always excluded from the club. But then, such a club is one I would not knowingly join, for I intuitively know the price of such moral compromise - as do we all, now.
These are people who have played the political game since grade school, have profited and triumphed along the way, having left metaphorical and perhaps even a few literal corpses in their wakes; certainly shattered hopes, ruined careers and frustrated dreams. In order to look at themselves in the mirror every morning, they have internalized the emotionally convenient myth that the opportunity to abuse someone proves that that person deserves to have been abused. They are "losers" and "losers" exist to prove that the winners won.
There are ways to explore this dynamic ethically and to the mutual satisfaction of those with complementary kinks for submission and domination - but I do not see much evidence of the concept of Safe, Sane and Consensual evidenced in the halls of Congress or Parliament.
The effect upon my life by people like Dick Cheney and Nancy Pelosi has been catastrophic; quite reasonably comparable to surviving childhood in a war zone.
This in turn led to a lifetime fascination with the sorts of people that would do that sort of thing, and what means they would use to make it seem needful to those who might otherwise interfere with them. And I say it having had unfortunately intimate experience with both sides of the coin. Having been raised by a sadist and a masochist, I have lived my life with that as my primary perspective of natural human relationships. Unlike my parents, I preferred to explore alternatives to accepting my fate as part of a package labeled "Traditional Family Values," so I've managed to avoid harm more often than not.
I can tell you, the most usual way to deal with the inevitable blow-back is to make the resistance to authority abuse a mandate for yet more abuse. CF: War On Terror, War On Drugs, scholastic Zero Tolerance policies. Goodness, the US BATF can trace it's roots to The Whiskey Rebellion! It's quite a fulfilling little pattern of denial - for professional perps.
Ultimately, I've found no better answer than what I wrote here; None Dare Call It Sadism.
It's about power, and the pursuit of power and it's exercise over others is a perfume with appeal that is irrelevant to partisan politics - and subversive of any principles that one on the quest for power might yet retain when they grasp the rose.
Human nature leads us to lash out, to focus our rage and fear upon a target and make them live with the insecurity we felt. It is, indeed, quite cathartic, even vicariously. And, as one can easily discern from just a slight insight into the political dynamics in Washington surrounding the commission of unquestionable, documented, brutal war crimes; complicity in a crime "for the greater good" is one of the better tools for building and maintaining a power base.
This might also give you some insight into the real reason for warrantless wiretapping. If there's no need for warrants, one does not need to explain exactly why one wishes to tap Nancy Pelosi's telephone.
Speaking for myself, I can say with certainty that while I completely understand the urge to punish those associated with grave crimes and extract from them whatever they may know about other participants in the process of making them justly suffer - I am also absolutely convinced that it is futile, largely by the experiences of those who have done it, and had it done to them.
Torture gains you words that you wish to hear, not information that you need to know. It's emotionally rewarding, but it in no way serves the task of making any nation or person safer. But then, a genuinely safer nation is not at all in the interests of those who's power base depends upon a strong "national security" infrastructure. The perceived threat must exist to justify the expense and the moral compromise. So the paradox is both inevitable and necessary; that the offenses committed in the name of security create new and greater threats to the security of the people.
The horrific and incompetent injustices committed upon the innocent and the possibly guilty alike have made cause for those outraged to hang all the slights, insults and offenses of the last century upon, and ram them home with the full force of international law.
It could, conceivably, become a pretext for war - for George Bush set the precedent for that, citing the mistreatment of political prisoners as one reason to invade and "clean up" Iraq.
And yet, people like Sheriff Joe Sheriff Joe Arpaio and Sheriff Tim Swanson are allowed to run around and brag about their approaches to criminal justice.
You see, torture becomes excusable when we are already numb to the routine abuse of authority, when is seen as a tool to be used when necessary for the greater good - and it's misuse can be cloaked in the wishful misunderstanding that anyone who IS mistreated must therefore have deserved it.
This, in regards to the notorious Hope Steffey case.
Of course, far from enhancing the rule of law, such actions and excuses for such actions make contempt for the law - and law enforcement professionals - normal and expected.Just to give you an example of some of the things being said on the Internet:
Wow. I can’t believe how much you guys are throwing a fit over this. The LEOs knew two things:
1) She was trying to get someone arrested and prosecuted for a violent offense for which he would probably end up imprisoned and beat/raped.
2) She was lying to them. And you think that they’re wrong for what they did?! What the effin eff?!
posted by jock@law at 6:52 PM on www.metafilter.comI guess we can’t expect much from a guy who calls himself “jock@law”.
Mercenaries almost always prefer massive overkill - because it minimizes their personal risks. Of course, it also means they consider themselves separate from and not answerable to the folks they may find themselves shooting. Hell, Hessians didn't even consider themselves part of the same physical Empire!
Now, when I see street cops expressing that same attitude, of not even being in the same empire as the ordinary schlubs they deal with every day, it seems to me that we have become two entire empires - those who get to tell the police who to beat up, and those the police get to charge with the "crime" of scuffing the officer's shoes with their objectionable asses.
In fact, torture and more generally, the abuse of power against those weaker is inherently corrupt, can never be excused nor permitted, for when it becomes commonly allowed, it pervades and corrupts the society as a whole - from family to government, and every single human institution in between.
It saddens me that I say nothing greatly different than would have Jefferson, Hamilton, Locke or Mill; indeed, I say nothing here that Sun Tsu would disagree with.
The last couple-hundred years have made it clear that the resolution to act justly in the face of perceived threat is more difficult than might have been thought - but that price is still lower than the price of becoming what we abhor.
In order to deal with genuine threats justly and appropriately, we must abandon the idea that it is ever a reasonable thing to torture another human being, to impose our will upon others to force them to do as we would have them do, to make them bend the knee and serve our desires, whether it be abstractly - for power, prestige and petroleum, or in the ultimate personal sense, for the sense of personal victory, or sexual conquest.
For at the root, it's no different, and the stain is no less persistent for being a collective debt. Further, in pandering to the false idea that security is something that people in power over us are able to provide - rather than co-ordinate and inform - we abandon our own ethical and practical responsibilities to one another. We are our brother's keepers - and no artificial distinctions between peoples and nations changes that elemental fact. Where there is hunger and poverty, where there is strife and fear, any policy that increases those deficits will also increase those risks - and, by fact of being crimes, justify, in a legal or at least arguable sense, attempts to gain recompense.
That is not a philosophy of "Liberal Appeasement," it's a matter of fact as illustrated by history, empowered by the most basic insights into human nature. If you do not wish to be the target of terrorism, the first and most basic policy is to make it a matter of practice to NEVER scare anyone so badly nor place them in such an impossible situation that it seems both reasonable and the only possible course of action.
Only those who profit - financially or emotionally - from the direct or vicarious abuse of others find this to be arguable. So if you find yourself arguing with me - don't expect me to regard your arguments with much sympathy. I've heard them. They were not novel in the times of Sophacles or Jesus. They were dismissed by the Buddha and embraced by Sun Tsu as a fatal weakness to be exploited in an enemy. These insights led in great part to the various victories of Mao Tse Tung, Fidel Castro and Ho Chi Minh - as much due to the complling lack of moral standing held by western powers as to the moral and philosophical high ground they claimed. Indeed, they did not have to be far above moral sea level to shine by contrast in light of what the various popular movements had directly experienced. Hell, they only needed to keep their moral nostrils above water to benefit!
And in each case, it took a great deal of rhetoric and scare-mongering to excuse the history we had been culpable of facilitating, profiting by or directly participating in.
I am in my fifth decate of life, and I have yet to see an example in practice of the ends having justifed the means in retrospect. At best, I can say that there have been some examples of the triumph of the lesser evil - but that that any advancement of the greater good has been largely in spite of such outbursts.

The Bitter, Low Hanging Fruit Begins to Fall

Pennsylavnia cop killer obsessed with conspiracy theories:
"Richard Andrew Poplawski was a young man convinced the nation was secretly controlled by a cabal that would eradicate freedom of speech, take away his guns and use the military to enslave the citizenry. It seems like I've been writing about this sort of thing from various angles for years now. Bad ethics, poor education, bad fellowship, gullibility and probably some combination of depression and early trauma came together to create a lethal mixture.
His online profile suggests someone at once lonely and seething. He wrote of burning the backs of both of his hands, the first time with a cigarette, the second time for symmetry. He subscribed to conspiracy theories and, by January 2007, was posting photographs of his tattoos on white supremacist Web site Stormfront. Among his ambitions: 'to accumulate enough 'I punched that [expletive] so hard' stories to match my old man.'"
Whether that lethality is the result of deliberate policy or simply toxic waste from a conspicuously tactical political agenda is, sadly, immaterial. Cause leads to effect, regardless of intent. Part of the effect of this attempt to "defend the Second Amendment" is to become far more a threat to legitimate recreational, survivalist and well balanced self-defense advocates than any "left wing" agenda.
It's not the tools. It's not the cause. It's the culture that has gotten stuck to the cause and the tools; it's like gun grease; You just can't get the smell off your hands.
For most of us, this sort ignorant, testosterone-fueled gullibility passes soon enough; we grow up, we get a life, we get married and begin careers. All of these things tend to socialize us, give us the opportunity to reality-check our views about other people, politics and life. But this only works if we allow it to work; if we do not expressly reject all the countervailing hints that life is an exercise in pastels and shades of gray, not black and white with Red White and Blue. (Or Red and White, domestically speaking.)
When you isolate yourself, surround yourself with like minded people and rigidly maintain an authoritarian world view - well, let's just say that it's a failure-prone situation. Maintaining that zone of absolute control requires an "or else." The more absolute the control, the greater the violence that you have to promise as a consequence of "misbehavior."

Police: Dad killed 5 kids because wife was leaving
Tammy Dettwiler, right, and her sister Penny Flansburg, left, are comforted by Dettwiler's son, Tim Martin, center, Saturday, at trailer park near near Graham, Wash., where the bodies of five children belonging to the women's niece Angela Harrison were discovered dead in their home Saturday afternoon. (Ted S. Warren / AP)
The night before, the father and his eldest daughter went in search of the wife, Angela Harrison. The daughter used a GPS feature in her mother's cell phone to find her with another man at a convenience store in Auburn, said Ed Troyer, a spokesman for the Pierce County Sheriff.
You might be tempted to dismiss this as inexplicable, the sort of insanity that simply cannot be predicted or anticipated. But in fact, it makes perfect sense to an extremely authoritarian parent, and the patterns of that sort of authoritarian personality [pdf] are there for anyone to see. Isolation. Micromanagement. Control. Restrictions on behavior, thought control, arbitrary rules that control every aspect of life. And no matter how it's packaged, no matter what excuses or doctrines are presented, it is always about power and control. I guarandamntee you that that home will be filled with symbols and totems that underline the maculine authoritarian right to dominate and control, much as Poplawski chose to conspicuously tattoo himself with a Teutonic eagle. The woman told her husband she was not coming home, and was leaving him for the man with her at the store. The father and the daughter left, distraught, Troyer said. Sometime after the children went to sleep, he shot them each multiple times. Four died in their beds. The fifth was found in the mobile home's bathroom, surrounded by signs of violent struggle.
James Harrison's world was wrecked by his wife's break for freedom; his self-worth depended entirely upon controlling and dominating his family - and his wife was the keystone. Without her example of mute compliance, how long would it be before his children escaped? This was of particular urgency, given that his eldest was already older than when he impregnated her mother - who was 13. He'd already "had to" commit a "minor assault" on one of his children in a way that his exercise of control was noticed by others. He could feel his grip slipping - and this translated into anger and fear, which turned inward and was focused upon his own children.
"He wanted the kids dead," Troyer said. "It wasn't like he shot a few rounds. He shot several rounds."

Investigators believe he then returned to the area near the convenience store looking for his wife. His body was found near the store, Troyer said.
"A working theory is that he probably went back up there looking for her, wasn't able to find her, realized the gravity of what he'd done and shot himself," Troyer said.
The story mentions that several weapons were found in the home. Given the personality type, we can safely assume that they were as much symbols of authority as hunting or sport weapons.
From a Buzzflash review of Gun Show Nation, by Joan Burbick
Guns do more than just shoot; they are powerful iconic symbols in American culture and have been used to label who's in and who's out; who is a "real American" and who is not.
More disturbingly: "She found hate literature at all the guns show that she attended, except for one. That should tell you something in itself."
I'm not saying that Harrison was exactly the same sort of nut as conspiracy-theorist Richard Andrew Poplawski, I'm not saying Harrison took Limbaugh or Beck as Serious People With Opinions That Matter. What we DO know about him is a related syndrome - a wide streak of authoritarianism, a need for control and the willingness to use violence to get his way.
Candy Johnson, Angela Harrison's aunt, described James Harrison as a strict, controlling husband and father who didn't allow his wife to make any decisions without asking him first."My niece has been so controlled from the time she was young," Johnson said, adding that James Harrison had impregnated Angela when she was 13.
"It's unbelievable," Johnson said. "My whole family is in shock. How does this happen? How does anyone do that?"
Others will tend to blame the guns and ammunition. I disagree - guns are in some ways innocent victims of "gun culture." If it's simply about killing people, In this day and age, it's not at all difficult to come up with truly lethal substitutes for conventional munitions. I could easily create such a text - but as tempting as it is to make a small fortune selling it to Paladin Press, I shall refrain.
Just take my word for it that available materials - electronics, compressed gasses, commonly available explosives, easily available high strength materials and common, Yankee ingenuity have already managed to come up with some pretty damn terrifying ideas.
Now, that's what you can accomplish with a spare bulldozer and a little jack-leg engineering skill. "Killdozer" could have gone one on one with many WWI tanks and turned them into scrap metal. Now, imagine if it had mounted a slightly more sophisticated variation of this terrifying device developed for - of all people - the US Department of Agriculture!

(Joel Suprise previous owner of spudtech.com)
Trust me - if you are even slightly male, you want to see the video.Above is a picture of the massive custom air cannon that was built for the US Dept. of Agriculture a few years back. It's a tornado simulator designed to fire a 12 foot long, 15 pound 2 x 4 at a wall at 100 MPH. Testing this monster was a RUSH!!!! Believe it or not... 22 of these "pneumatic artillery pieces" have been built. Click HERE for a video.
Of course, it has no reloading mechanism, no elevation controller, no way of aiming it, and two-by-fours are hardly aerodynamically stable. So, as is, it doesn't seem all that terrifying a weapon.
Until you realize that the only reason that it's a lousy weapon is because nobody has added possibly fifty dollars worth of extra parts and a small computer. With that tiny addition - and an easily added breach mechanism - this monster could be flinging spears, metal and concrete projectiles, explosives, or anything else with impressive accuracy. This is damn impressive artillery - and it's actually more sophisticated than a field mortar.
Here's the problem; you cannot outlaw physics. This is why the right to bear arms is in fact an inalienable right. Pass all the laws you wish; it's quite immaterial, if the people you legislate against having weapons feel safer having them then not. This thing could easily be used to level a police station, in either direct or indirect fire mode. Even more fearsome things can be created with a trip to a junk yard and a welder's ticket. "Punkin' Chunkin" air cannon can fling a pumpkin - not the most ideal projectile in the universe - over a mile. Imagine the same device being used to launch a fin-stabilized projectile?
Oh, and did you know there are amateur rockets that can launch a bowling ball over a thousand feet - straight UP?
The problem is not one of availability or even of effective lethality. It's all about symbolism, will and intent. Punkin' chunkers and amateur rocketeers don't belong to toxic subcultures. They are gleeful, playful kinetic engineers. They don't sit in the dark jacking their slides and fantasizing about putting a full mag into someone deserving.
While amateur rockets and air-powered kenetic weapons are, or could be devastatingly lethal, they simply don't communicate to the psyche the way an AK-47, a Colt .45 or an M16. It's not what the weapon can do - it's about the associational values and the culture they serve as totemic badges.
Let me illustrate by counterexample.
This weapon fires 11 3/4 mm lead ball (.463" caliber) with air pressure supplied by a bike pump.
It was created in WWII by a French bicycle-maker turned partisan, out of what appears to be common plumbing pipes. And it very likely has several bodies on it.
It's capable of perhaps 10 or 20 shots at useful power, and it's a true semi-auto.
By useful power, I mean somewhere in the neighborhood of ".38 Special area of modern firearms, or even, as probably overstated by Fred Baer (1973) into the range of the .45 ACP cartridge, famous in pistols and submachine guns favored by police, gangsters, and the military for several wars of the 20th century." -Beeman
That is certainly impressive lethality - but it's cultural connotation would be "child's toy." Even though it will cheerfully create messes like this, it's a seen as a geeky, steampunk curiosity, although it should be intuitively seen as a truly amazing survival tool, easily capable of taking deer and smaller game.
You can build your own with parts from any hardware store. The ammunition is cheap or free. It's perfect for recreational shooting - if that shooting is not about conspicuous consumption and vicarious violence. If your "recreational shooting" is about proving that you can afford to feed your weapon, and therefore that you are a "solid citizen," an air rifle simply will not serve your needs.
Even though it actually would - if shooting was about feeding and defending your family.
Weapons of this sort are used even today as very serious hunting weapons, capable of firing a wide range of lethal projectiles. Are they part of American Gun Culture? Nope. Nobody takes you seriously if you brandish an air rifle - because they don't go "bang."
I see the Knob Creek Machine Gun Shoot as being a malignant devolution of Potlatch culture - an exercise in white male bonding and cultural immersion. It glorifies violence, paranoia and authoritarian group-think. And this is the culture that produces people like Richard Andrew Poplawski
and James Harrison.
It's all about the upbringing, the culture and the associations. The guns, as I said, are innocent bystanders - chosen for their appearance of power, rather than their functional effectiveness.
I hate to say this - but we have to. This is NOT a "Second Amendment" problem. It's a "First Amendment" problem. It comes directly from willful misinformation; lies and deceit. I think it's time to talk about means to regulate culture. I don't favor a legal approach - what I do favor is a far stronger and more effective cultural approach. We - sane, freedom loving people - need to take over the soapboxes. We need to verbally and materially demonstrate our displeasure with and informed dissent with xenophobic idiocy and special interest sedition.
Real Men don't shoot kids. They don't excuse it as "the price of freedom," either. Rational people - even rational paranoids - don't create pretexts to kill people, to "defend their rights." And most particularly, they don't kill pointlessly, just to make a conspicuous show of their demise. That's not patriotism, it's terrorism.
So, when you see cultures like this - and you hear them howling about being "profiled" due to their association with various political groups and activist associations known for their problematic - nay, wackadoodle belief structures - respond with a horselaugh. They are potential terrorists. Tim McVeigh came from JUST such a subculture. So did these two. They all have a common thread - the belief that they are - or were - right, and have the right to use force to impose their world view.
They belive they have the right to freely assemble in order to present an "or else" to the rest of us. Well, I suppose, strictly speakiing, that's true. But they don't have the right to do so without the rest of us taking notice - and a few reasonable individual and collective precautions.

Hope Steffey; Starke County's Internet Fueled Nightmare.
A quick recap.
And then it got bizarre.Hope Steffey's night started with a call to police for help. It ended with her face down, naked, and sobbing on a jail cell floor. Now, the sheriff's deputies from Stark County, Ohio who allegedly used excessive force during a strip search 15 months ago face a federal lawsuit, and recently released video won’t help their case.
Steffey's ordeal with the Stark County sheriff's deputies began after her cousin called 9-1-1 claiming Steffey had been assaulted by another one of their cousins. When a Stark County police officer arrived, he asked to see Steffey's driver's license. But instead of handing over her own ID, she mistakenly turned over her dead sister's license, which she contends she keeps in her wallet as a memento. That's when the situation became complicated.
"Hope was not treated as a victim," her lawyer told WKYC News. "The officer said to her 'shut up about your dead sister.'"
WKYC reports that since the release of the now-notorious Hope Steffey ’strip search’ video, 4 more Stark County, Ohio women, including Valentina Dyshko of North Canton, have come forward alleging that they were forced to remove their clothing when detained at the Stark County Jail...BL further reports in a subsequent article that the State Attorney General will be looking into the entire matter.Larry Shields of the Salem News reports that Stark County Sheriff Tim Swanson has officially requested that Ohio Attorney General Mark Dan “review all the circumstances surrounding the arrest and incarceration of Hope Steffey in October of 2006,” a vicious incident labelled “way out of line” by Cuyahoga county Sheriff Gerald McFaul (h/tThePoliticalCat).
Additionally, Muriel Kane of The Raw Story reports that video footage taken prior to the now-infamous strip search tape may exist, noting that “jailhouse surveillance cameras show a deputy with a handheld camera filming Steffey being escorted to her cell.”
Kane also suggests that dashboard video of the arrest, originally believed to be non-existent because the arresting officer claimed the camera was off, may not have been disclosed to Steffey’s lawyers.
According to a grand jury, Stark County deputies committed no criminal acts while arresting Hope Steffey two years ago. Nancy H. Rogers, Ohio attorney general, issued a statement saying that a Stark County grand jury did not hand down any indictments after reviewing the evidence presented by the state’s Bureau of Criminal Identification and Investigation Special Prosecution Sections.
The Steffey case was investigtated by Paul Scarsella, the Chief of the Special Prosecutions Section for the Attorney General’s Office where he manages 4 attorneys and support staff. He was assisted by Bridget Carty, Public Integrity Unit Coordinator, and an Assistant Attorney General in the Special Prosecutions Section.
The Special prosecutors, Paul Scarsella and Bridget Carty, said the incident, in which male and female deputies forcibly removed Steffey’s clothes at the Stark County jail, was a suicide precaution. They said the deputies were only following a medical order given by a doctor on duty to remove her clothes. Though the jail has suicide suits for inmates to wear, prosecutor Scarscella said Steffey was not immediately given one because even the suit was deemed too dangerous for her to have.
The Special prosecutors presented the results of their investigation to the grand jury without interviewing Hope Steffey. They said they were unwilling to interview her with her lawyers present, as she requested. Steffey did however appear before the grand jury. The grand jury declined to indict the deputies involved.
Steffey denied that she was suicidal or was given the opportunity to remove her clothes herself. There is no policy that prevents men from removing a female inmate’s clothes during a suicide precaution situation. Men are however prevented from strip-searching a female inmate.
However, the findings of this grand jury will have no bearing on the federal lawsuit that Hope Steffey filed on Oct. 2007, accusing Stark County deputies ofviolating her civil rights by assaulting, strip-searching and leaving her injured and naked for six hours in a Stark County jail cell. She had to use toilet paper to cover herself. Defendants in the case are Swanson, Deputy Sheriff Richard T. Gurlea Jr. and one to 15 other “John and Jane Does” employed at the Stark County Jail, and the Stark County commissioners. That case is scheduled to go to trial in December.
The plaintiffs are six Stark County sheriff's deputies " Kristin Fenstemaker, Laura Rodgers,
Tony Gayles, Richard T. Gurlea Jr., Andrea Mays and Brian Michaels " whom the lawsuit states suffered humiliation, severe emotional distress, disrepute in the community, and loss of wages and employment.
The suit stems from investigations and news stories by WKYC TV Inc. and its reporter which "portrayed the deputies as abusing their power, abusing an inmate and wrongfully causing harm to an inmate" " Hope Steffey of Salem.
WKYC keeps up the pressure
Specifically named are news reporter Tom Meyer of WKYC TV; Gannett Company Inc., doing business as WKYC TV Inc. at 1333 Lakeside Ave. in Cleveland; and Gannett Satellite Information Network International, c/o CT Corporation at 1300 E. Ninth St., Cleveland. Also named as defendants are three people working for a Channel 3 news program, "The Investigator," whose "true names and addresses are currently unknown."
Sheriff Swanson says Steffey was considered suicidal so her clothes had to be removed for her own safety. Steffey has denied she was suicidal.
The woman's lawyers discovered during the lawsuit that at least 128 women between 1999 and 2007 were strip-searched or forced to remove their clothing or placed on suicide watch, homicide watch or "naked detention."
The lawyers were unable to obtain the names of these women due to privacy rights. They are using a billboard along a busy four lane road to encourage these women to come forward and to tell their stories.
"This is an honest attempt to find out what, if anything is happening inside that jail that violates constitutional rights," said David Malik, an attorney representing Steffey.
I keep finding other bloggers keeping up the story, and many concerned citizens following it - but very little other media, other than WKYC.
One wonders why. Considering just how juicy this story is. How very much it appeals to tabloid sensiblities. One wonders why it's not wall to wall on CNN and Fox. But it's one more illustration as to why cops fear cameras.
Sheriff Tim Swanson likes to make sure none of them pretty girls are suicidal.
Starke County deserves a Hellride for Hope.
